1. Introduction

Welcome to Take Off Yachts ("Company", "we", "our", "us"). These Terms and Conditions ("Terms") govern your use of the Take Off Yachts website (takeoffyachts.com) and all related yacht rental and charter services ("Service"). By using our Service, you agree to be bound by these Terms. If you do not agree, do not use our Service.

2. Eligibility

2.1 You must be at least 18 years old to make a booking or enter into a contract with us.

2.2 Minors and teenagers must be accompanied by a responsible adult when booking and during any yacht trip. Unaccompanied bookings by individuals under 18 are not permitted.

3. Booking and Reservations

  • All yacht bookings are subject to availability and written confirmation by us.
  • Bookings will be confirmed after receipt of a deposit payment or full payment as specified during the booking process.
  • You are responsible for reviewing all details of your reservation. Any errors should be reported immediately.
  • The person making the booking ("Lead Guest") is responsible for sharing these Terms with all guests in their group and ensuring compliance.

4. Payment Terms

  • Payment methods include bank transfer, credit card, or other methods as stated at booking.
  • A deposit or full payment is required to secure your booking.
  • All fees are stated in AED and exclusive of VAT unless otherwise specified.
  • Remaining balances must be paid before boarding unless otherwise arranged.
  • Failure to pay on time may result in cancellation without notice.

5. Cancellation and Refund Policy

Cancellations by the client must be made in writing (email, online form, or through your booking account).

Refunds depend on notice period:

  • More than 7 days' notice: full refund
  • 3–7 days' notice: 50% refund
  • Less than 72 hours' notice: no refund and 100% charge

Cancellations or modifications due to weather, safety, or operational issues are at our discretion. In these cases clients will be offered a reschedule or full refund without penalty.

6. Charter Operations

The captain and crew have full authority over safety and navigation at all times. Guests must comply with all instructions from crew or staff while on board or at the marina. The captain may alter routes or terminate the charter if it is necessary for safety.

7. Guest Conduct and Responsibilities

  • Ensure the number of guests does not exceed the yacht's maximum capacity. Overcrowding is not permitted. Additional people (DJ, service providers such as bartenders, and staff aside from captain and crew) will be counted as guests.
  • Guests must behave respectfully towards yacht staff and other passengers. Misconduct may result in immediate termination of the trip without a refund.
  • Guests must follow local Dubai Maritime Authority laws and regulations.
  • No illegal substances or items are permitted.
  • Actions that threaten safety may result in termination with no refund.
  • Damage caused by negligence or misuse will be charged to the Lead Guest.

8. Alcohol, Food, and Catering

Alcohol consumption is allowed for adults. Illegal substances are strictly prohibited. Smoking is allowed in designated areas only. No underage drinking is permitted.

Catering must be arranged through Take Off Yachts or with written approval for outside vendors. All food allergies or dietary restrictions should be disclosed before the charter.

9. Weather and Force Majeure

Charters may be rescheduled or cancelled due to weather or circumstances beyond our control (force majeure). We are not responsible for delays or losses caused by factors outside our reasonable control.

10. Liability and Insurance

  • We maintain standard insurance coverage for our vessels and operations as required by UAE law.
  • Guests are responsible for their personal belongings. Take Off Yachts is not liable for lost or damaged items.
  • Guests will be held responsible for any damage caused to the yacht or its equipment during the rental period.
  • To the maximum extent permitted by law, Take Off Yachts and staff are not liable for injury, loss, or damage arising from use of our Service, unless caused by proven negligence.

11. Intellectual Property

The website content, images, and trademarks are the property of Take Off Yachts or its licensors. You may not use or reproduce any material without written consent.

12. Termination

We reserve the right to cancel, suspend, or terminate any booking, charter, or account at our discretion for non-payment, policy violations, unavoidable circumstances, and safety concerns.

13. Changes to Terms

We may update or modify these Terms from time to time. The latest version will always be posted on our website. Continued use of our Service means acceptance of any updated Terms.

14. Governing Law

These Terms are governed by the laws of the Emirate of Dubai and the UAE. Any disputes will be subject to the exclusive jurisdiction of Dubai courts.

15. Lost and Found

We are not responsible for any personal items left on board after your yacht trip. Clients must claim lost items before leaving berth. Claims made after this time will not be processed, and recovery cannot be guaranteed. Please check your belongings before leaving the yacht.
